These Terms of Use (“Terms”) govern your access to and use of the Lead Response System (“Service”) provided by DigiSpark (“we”, “us”, or “our”). By registering for or using the Service, you (“you”, “your” or “the User”) agree to be bound by these Terms.


1. Service Overview

The Lead Response System is a cloud-based SaaS platform designed to automatically respond to lead emails using AI. Users authorise read and write access to their inbox so the Service can:

Analyse emails using AI technology hosted on n8n workflows;Detect and classify lead enquiries;Generate automated responses using AI;Use information from an XML feed (provided by you) to enrich responses with relevant property information.

2. User Data & Access

To provide the Service, we collect and store the following information:

Your name, email address, and business name;Your authorised access credentials (limited to your inbox and relevant folders).

By using the Service, you expressly grant us permission to access, analyse, and respond to emails on your behalf. You understand that email data is processed by AI and external systems integrated within n8n workflows.

3. AI Response Disclaimer

You understand and accept that:

Responses generated by the AI Agent are automated and may not always reflect your brand voice or intent;DigiSpark does not store any lead information in OpenAI;DigiSpark accepts no liability for the content of responses generated by the AI Agent;You are solely responsible for reviewing or supervising email activity if necessary.

4. User Responsibilities

You must ensure that the XML feed and email access credentials you provide are accurate and up to date;You agree not to use the Service for unlawful, unethical, or prohibited purposes;You acknowledge that all interactions with your email inbox through the Service are done with your full authorisation.


5. Service Availability

We strive to maintain uptime and secure operation, but:

Service uptime is not guaranteed;Maintenance, updates, or third-party outages may affect availability;Email support is available for issues, and we will respond within a reasonable timeframe.


6. Termination of Access

We reserve the right to:

Suspend or terminate your access to the Service at any time, with or without notice, for any reason including misuse, breach of these Terms, or at our sole discretion.


7. Free Trial & Payment

A 14-day free trial is available to new users;After 14 days, you will be automatically billed via Stripe unless you cancel before the trial ends;Payments are non-refundable, including partial months or unused features;You may cancel your subscription at any time via your account or by emailing us;Prices are subject to change. We will notify you in advance of any pricing updates.


8. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will take effect immediately upon posting. Continued use of the Service after changes indicates your acceptance of the revised Terms.


9. Limitation of Liability

To the fullest extent permitted by law:

We shall not be liable for any loss, damage, or consequences arising from use of the Service;This includes, but is not limited to, data loss, missed leads, or unintended email content;The Service is provided “as is” without warranties of any kind, express or implied.


10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of

England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
